Article 1 Scope
This is an agreement between you and Pornvestors S.L., Barcelona, Spain (hereinafter referred to as “MYGONZO.TV”). Please read these terms of use related to the myGonzo.TV Video On Demand (VOD) service on the page www.mygonzo.tv (the “Site”). You agree to those terms by entering into the agreement or using the Service.
Article 2 Service
The myGonzo.TV Video On Demand (VOD) service (the "Service") offers digitized versions of adult movies, erotic shows, gangbang events, casting events, and other video content (collectively, "Digital Content"). The Service allows you to access and view Digital Content by streaming a copy to your device.
Article 3 Compatible Devices
In order to be able to stream Digital Content from the Service and to view Digital Content on the Service, you will need to use a personal computer, portable media player, or other device that meets the system and compatibility requirements that we establish from time to time and is otherwise capable of interacting with the Service (each such device, a "Compatible Device"). We may change the requirements for Compatible Devices from time to time and, in some cases, whether a device is (or remains) a Compatible Device may depend on software or systems provided or maintained by the device manufacturer or other third parties. As a result, devices that are Compatible Devices at one time may cease to be Compatible Devices in the future.
Article 4 Eligibility
You must be 18 years of age or older to use the Site or the Service. Use of the Site or the Service is void where prohibited. You represent and warrant that the information you submit is true and accurate and that you are 18 years of age or older and are fully able and competent to enter into, and abide by the terms of this terms of use. The Site and the Service are not intended for those under the age of 18. You represent and warrant that you do not find pornographic materials offensive or indecent and that you will not allow any person other than yourself to utilize your user account.
Article 5 Responsibility
You are the only one responsible for the safekeeping of your password and for handling your user data. Please, change your password on a regular basis. Do not disclose to third parties your user information (Username and password). You are the only one responsible for the activities related to your user account as well as for the activities related to your user account which you have transferred unjustifiable to third parties.
Article 6 All rental and sales are final
All purchases and rentals of Digital Content are final. We do not accept returns of Digital Content.
Article 7 Digital Content
(1) The Service allows you to rent Digital Content for viewing over a limited period of time ("Rental Digital Content") or purchase Digital Content for viewing over an indefinite period of time ("Purchased Digital Content”) The basis on which Digital Content is available on the Service will be indicated on the product detail page for that Digital Content on the Service. From time to time, we may add or remove Digital Content from the Service and may change the basis on which Digital Content is available on the Service.
(2) The Digital Content we make available to you on the Site are subject to the following rules:
Purchased Digital Content: You may stream purchased videos online through your Web browser on Compatible Devices by using your MYGONZO.TV account. You may stream just one video at the same time using the same MYGONZO.TV account. You may watch and re-watch your purchased videos as often as you want and as long as you want (“Viewing Period”).
Rented Digital Content: You may stream rented videos online through your Web browser on Compatible Devices by using your MYGONZO.TV account. You may stream just one video at the same time using the same MYGONZO.TV account. You must complete watching rental videos within a window of 48 hours from your payment of the rental fee (“Viewing Period”).
(3) Subject to your payment to rent, purchase, or otherwise obtain access to Digital Content MYGONZO.TV grants you a non-exclusive, non-transferable, non-sublicensable, limited right and license, during the applicable Viewing Period, to access, view, use and display the Digital Content in accordance with the rules. , for Non-Commercial, Private Use. As used herein, "Non-Commercial, Private Use" means a presentation of Digital Content for which no fee or consideration of any kind (other than that which you pay to us to view the Digital Content) is charged or received, which takes place in your private home or apartment or, if outside your private home or apartment (e.g., in a hotel room, dorm room, office, or airport waiting lounge) is limited to a private viewing for you and your invitees. Non-Commercial, Private Use specifically excludes any public presentation (e.g., a presentation in a dorm lounge) and any presentation by a place of public accommodation or other commercial establishment (e.g., a bar or restaurant), even if no fee is charged for viewing the Digital Content.
(4) Purchased Digital Content will generally continue to be available to you for streaming from the Service, as applicable, but may become unavailable due to potential content provider licensing restrictions and for other reasons, and MYGONZO.TV will not be liable to you if Purchased Digital Content becomes unavailable for further streaming.
(5) When you stream Digital Content, the resolution and quality of the Digital Content you receive will depend on a number of factors, including the type of Compatible Device on which you are streaming the Digital Content and your bandwidth, which may go up and down over the course of your viewing. If we detect that Digital Content we are streaming to you may be interrupted or may otherwise not play properly due to bandwidth constraints or other factors, we may decrease the resolution and file size of the Digital Content we stream to you in an effort to provide an uninterrupted viewing experience.
(6) You may not transfer, copy or display the Digital Content, except as permitted in this terms of use. In addition, you may not sell, rent, lease, distribute, broadcast, sublicense or otherwise assign any right to the Digital Content to any third party; remove any proprietary notices or labels on the Digital Content; or, use the Service or Digital Content for any commercial or illegal purpose.
Article 8 Termination
If you violate any of the terms or conditions of this Agreement, your rights under this Agreement will automatically terminate without notice from us, and MYGONZO.TV may, in its discretion, immediately revoke your access to the Service without notice to you and without refund of any fees. In such event, you must delete all copies of Digital Content that you have downloaded, and MYGONZO.TV shall have the right, without notice to you, to automatically discontinue your access to Digital Content from the Service.
Article 9 Modification of Service
MYGONZO.TV reserves the right to modify, suspend, or discontinue the Service, or any part thereof, at any time and without notice to you, and MYGONZO.TV will not be liable to you should it exercise such rights, even if your use of Digital Content is impacted by the change.
Article 10 Disclaimer
MYGONZO.TV provides no warranty for the Service. Especially, MYGONZO.TV provides no warranty for the availability of the Service and for the performance of the Video Streaming.
Article 11 Exclusive Reseller
The invoicing and payment procedure to give you access to the Digital Content on this Site is performed exclusively by resellers. All transactions performed via our Site are conducted by our business partner Paybilla.
Article 12 Applicable law
The applicable law is the Spanish law and the UN Convention on contracts for the international sale of goods (CISG) is excluded.
